General terms of sale

Preamble
The present “General Terms and Conditions of Sale” apply to legal transactions relating to the products marketed to its customers by SARL LAMBAY ERIC within its virtual online store.

Definitions:
The following words or expressions shall have the following meanings:
Watch Paris Watch: refers to the ERIC LAMBAY SARL through its Watch Montre Paris website.
Internet shop: means the website of SARL ERIC LAMBAY on which the Products are presented and sold to customers.
Order: means the contract of sale concluded between SARL ERIC LAMBAY and the customer of the Internet shop of SARL ERIC LAMBAY.
Product sheet: refers to the classified information concerning a product provided by SARL ERIC LAMBAY during the sale of the said product in its internet shop.
Products: refers to all the goods and services offered by SARL ERIC LAMBAY in its internet shop.
Service: means the sale of Products by SARL ERIC LAMBAY to the customers of its Internet shop.
Transaction: refers to all transactions, secure processing, authorizations and agreements relating to the payment of the price of Products ordered by bank transfer or credit card.

Article 1: object
The purpose of these General Terms and Conditions of Sale is to define the terms and conditions in which SARL ERIC LAMBAY offers and sells its Products to its customers. These general conditions of sale will prevail over all other conditions appearing in any other document, except preliminary, express and written exemption.

Article 2 – Acceptance of conditions
The customer acknowledges having read, at the time of placing an Order, these terms and conditions of sale and expressly accept them without reservation. The present general conditions of sale govern the contractual relations between SARL ERIC LAMBAY and its customer, the two parts accepting them without reserve.

Article 3 – Products
The majority of the products offered by SARL ERIC LAMBAY to its customers are immediately available, except articles reported as “sold”, “reserved”. However, all products marketed by SARL ERIC LAMBAY may or may not necessarily be sold online.

Article 4 – Order
Automatic registration systems are considered to be proof of the nature, content and date of the Order. SARL ERIC LAMBAY will confirm to the customer the acceptance of his Order by sending a confirmation message to the email address that he has communicated. The sale will not be concluded until the sending of the order confirmation. SARL ERIC LAMBAY reserves the right to refuse or cancel any Order from a customer especially in case of insolvency of said customer or in the event of a failure to pay the Order concerned or a previous delivery or a dispute over the payment of a previous order. The particulars indicated by the customer, when entering information pertaining to his Order, bind him. SARL ERIC LAMBAY can not be held responsible for the errors made by the customer in the wording of the address of the recipient of the Order (delivery address, billing address in particular) and delays in delivery or the impossibility to deliver the Products ordered that these errors could engender.

Article 5 – Delivery
After confirmation of the Order and subject to perfect payment of the price of the products ordered, SARL ERIC LAMBAY undertakes to send to its customer, under its responsibility, the products ordered to the delivery address within 48 hours except in exceptional circumstances ( temporary closure, carrier strike …). All the Products stipulated in the Orders placed with SARL ERIC LAMBAY are intended for the personal use of the customers or the recipients whose name is mentioned at the address of delivery. In this case, the customer agrees to settle upon receipt, all taxes, duties, taxes and other charges present and future due for the delivery of said products themselves; the joint and several liability of SARL ERIC LAMBAY can not at any time be engaged in this respect. The customers or the recipients of the Products are prohibited any partial or total resale of the Products. The delivery will be made by mail or other specialized of your choice. The possible delays of delivery attributable to the carrier or to SARL ERIC LAMBAY do not give the right to the customer to claim damages. Products ordered are transported at the risk of the recipient. Upon receipt of the Products ordered, the customer or the recipient must check the proper functioning of the goods delivered, and will be aware of its terms of use on the instructions for use that is provided. In the event that one or more of the Products ordered are missing or damaged, the customer or the recipient must make any reservations with the carrier at the time of delivery. In case of apparent defects, the customer has the right of return under the conditions provided in the instructions for use of the property. Are considered as force majeure releasing SARL ERIC LAMBAY of its obligation to deliver, the war, the riot, the fire, the strikes, the accidents and the impossibility to be supplied. For reasons of availability of the Products ordered, an Order may be the subject of several successive deliveries to the customer. In the event that the customer would like the Products ordered to be delivered to two different addresses, it will be necessary for the latter to pass 2 separate Orders.

Article 6 – Retraction
The customer has a period of 14 days from receipt of the Products ordered to return to SARL LAMBAY ERIC for exchange or refund. In this case, the customer must return the new products in their original packaging, intact, accompanied by all possible accessories, instructions and documentation at the following address:

In case of exercise of the right of withdrawal, SARL ERIC LAMBAY agrees to refund the sums paid by the customer, free of charge, with the exception of the cost of return. The refund is due within a maximum of 15 days.

Article 7 – Price
The price is expressed in euro. The price indicated on the Product Sheets does not include the costs inherent to the transport. The price indicated in the order confirmation is the final price expressed all taxes including VAT. This price includes the price of the Products, the costs of handling, packaging and storage of the Products, transport costs and commissioning.

Article 8 – Payment
The price invoiced to the customer is the price indicated on the order confirmation sent by SARL LAMBAY ERIC. The price of the Products is payable in cash by one of the means of payment offered on the site on the day of the actual order.

Article 9 – Applicable law
These general conditions of sale are subject to French law. In case of dispute, the competent court is the tribunal de grande instance of Versailles or the commercial court of Versailles.Article 10 – Liability
SARL LAMBAY ERIC can not be held responsible for damages of any kind, whether tangible or intangible, which could result from a malfunction or misuse of the Products marketed. The same applies to any modifications of the Products resulting from the manufacturers. The liability of SARL LAMBAY ERIC will, in any event, be limited to the amount of the order and can not be blamed for simple errors or omissions that could have remained despite all the precautions taken in the presentation of the products. difficulties in the application of this contract, the customer and SARL LAMBAY ERIC reserve the possibility, before any legal action, to seek an amicable solution.Article 11 – Guarantee
In any case SARL LAMBAY ERIC can not be held responsible for the non-compliance with the regulations and laws in force in the country of receipt. The liability of SARL LAMBAY ERIC is systematically limited to the value of the Product in question determined at the date of its sale and this without recourse to the brand or the company producing the product.
In any case, the customer benefits from the legal guarantee of eviction and hidden defects provided for in articles 1625 and following of the Civil Code.

The information of the personal information collected for the purposes of the distance selling is obligatory, this information being essential for the treatment and the routing of the orders, the establishment of the invoices and contracts of guarantee. The lack of information leads to the non-validation of the Order. In accordance with the law “Informatique et Libertés”, the processing of personal information relating to customers has been declared to the Commission Nationale Informatique et Libertés (CNIL). The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of the data which concern him, which he can exert with SARL LAMBAY ERIC. In addition, SARL LAMBAY ERIC undertakes not to communicate, free of charge or with consideration, the details of its customers to a third party.
